Varna Court Opens Case Against NHIF for Hospital's Over-Limit Activity

Multiprofile Hospital for Active Treatment "St. Anna" - Varna is suing the NHIF for unpaid over-limit activity from August to November 2025. The hospital is claiming over 530,000 euros because the NHIF refuses to pay for medical services due to the application of monthly limits.

The Administrative Court in Varna has opened a case at the request of the Multiprofile Hospital for Active Treatment "St. Anna - Varna" against the National Health Insurance Fund.

The reason is that the fund has not paid for the over-limit activity carried out by the hospital. The lawsuit claims that the NHIF unjustifiably refuses to pay for medical activities performed and reported from August to November 2025, with the hospital claiming the sum of 525,775.58 euros principal and 5,573.79 euros compensation. The health institution is attacking the application of the so-called "monthly limits" (indicative values), emphasizing that they contradict the Constitution and Decision No. 6/11.04.2024 of the Constitutional Court.

The appeal emphasizes that as a medical institution with emergency and 24-hour admission, it is impossible for the hospital management to predict the number of patients, and the refusal to pay violates the rights of insured persons to accessible and timely medical assistance.

The request also states that at the time of the obligations arising, the Health Fund had the necessary funds in its reserve, but despite the invitation for voluntary execution sent on 12.01.2026, no payment was received. We remind you that due to the unpaid funds, the doctors from the "St. Anna" hospital did not receive their full salaries and on January 15 went on a protest. Later, the same problem - unpaid over-limit activity, was also announced by the "Varna" hospital.
