Antoaneta Vasileva – wife of banker Tsvetan Vasilev – has won a compensation case due to illegal prosecution and charges brought by the prosecutor's office. The decision calls into question the actions of the state prosecution against the family.

Tsvetan Vasilev's wife wins case against the prosecution

Antoaneta Vasileva, wife of banker Tsvetan Vasilev, has won a case against the Bulgarian prosecution due to illegal persecution and charges related to the investigations surrounding the bankruptcy of Corporate Commercial Bank (KTB). By court decision, the state prosecution has been ordered to pay compensation to Vasileva for non-pecuniary damages, including tarnished reputation and psychological harassment caused by the actions of the magistrates.

The case is yet another example of how charges brought in the context of cases against Tsvetan Vasilev and his family turn out to be legally unsustainable and collapse in court. Such decisions not only call into question the way the prosecution handles high-profile economic cases, but also pave the way for potential new compensation claims by affected individuals.

How the persecution against Antoaneta Vasileva began

A pre-trial proceeding for money laundering and participation in schemes around KTB was initiated against Tsvetan Vasilev's wife, and in parallel, she was the subject of a European arrest warrant and search. Due to international services, Antoaneta Vasileva was placed in a situation where she could not travel freely, and her name was permanently linked in the public space to serious accusations that never led to a conviction.

Despite the loud announcements from the prosecution, the pre-trial proceeding against her remained on the back burner for a long time without reaching the judicial phase and without convincing evidence being presented. Ultimately, charges were not filed, as Antoaneta Vasileva was treated only as a witness and not as a defendant during interrogations at the metropolitan investigation office, which further demonstrated the insecurity of the state prosecution's thesis.

The decision in favor of Vasileva

In its decision, the court accepts that the actions of the prosecution violated Antoaneta Vasileva's rights, including the right to private and family life, as well as the right to a good name in society. The court panel points out that for years she lived under the weight of accusations and an international search, which ultimately turned out to be devoid of any real legal basis.

On this basis, the court awarded compensation for non-pecuniary damages – a sum that should compensate for at least part of the moral and reputational damage caused. Beyond the financial dimensions, the decision also has symbolic value, as it recognizes that state repression against Tsvetan Vasilev's family crossed the line of what is permissible.

Context: the cases against Tsvetan Vasilev's family

In parallel with civil claims for damages, other cases are ongoing against Tsvetan Vasilev and his family, including the property confiscation trial led by the anti-corruption commission KPKONPI. Respondents in this claim are Vasilev himself, his wife, their daughter, as well as companies linked by the prosecution to the movement of funds originating from KTB.

Internationally, some of the attacks against the Vasilev family have already been called into question – international organizations terminated the search for the banker and his relatives after accepting that the alleged crimes did not meet the criteria for international prosecution. Vasilev's lawyers have argued for years that this is a politically motivated persecution rather than a purely legal case.

What the decision means for the prosecution

Antoaneta Vasileva's victory in court adds another element to the criticism against the way the state prosecution handles cases of the highest public interest. Convicting the prosecution for illegal persecution shows that a lack of sufficient evidence and the excessive use of repressive tools can lead not only to the failure of cases, but also to financial and reputational consequences for the institution.

At the same time, the decision provides arguments to those who insist on reform in the model of the prosecution and for stricter judicial control over the actions of the prosecution in complex economic and political cases. It also fits into a broader trend – people against whom cases have been led without sufficient legal basis are seeking protection through claims for damages both before Bulgarian courts and before international bodies.

Next steps for Antoaneta Vasileva

For Tsvetan Vasilev's family, the decision is a partial success, but it does not put an end to all the cases and audits being conducted in Bulgaria. Vasileva's lawyers have already hinted that additional compensation may be sought, including through complaints to international courts, if it is proven that the state has systematically violated the family's rights.

On the other hand, the prosecution will likely try to minimize the effect of the decision by presenting it as an isolated case that does not affect its overall strategy on the cases related to KTB and Tsvetan Vasilev. Public attention, however, shows that every such conviction against the state prosecution adds yet another doubt about the way the loudest cases of recent years have been conducted.

Ебате, пак става майтап! Не разбирам как може прокуратурата да си губи времето (и нашите пари) по този начин. Дано поне някой отгоре да се сети да провери кво се случва там... Все едно са им платени да защитават само Василев и мутрите около него. Срам! И после се чудим за

Абе, хора, сериозно ли сте?! Това дело май наистина показва колко яко е оплетола ситуацията с Василев и цялата работа покрай КТБ... кво искаме да кажем всъщност? Че прокуратурата ни е тотално неадекватна в някои случаи, нали така?
