Interior Minister Daniel Mitov ordered the preparation of a draft for a new Regulation on the conditions and procedure for providing protection of individuals. For this purpose, a working group has been established under the leadership of Deputy Minister Toni Todorov.
Currently, the protection of threatened individuals is regulated at the legal level in the Law on the Ministry of Internal Affairs (LMIA) and at the subordinate level in the Regulation on the Structure and Activities of the Ministry of Internal Affairs and the Regulation on the Conditions and Procedure for Providing Protection of Individuals. Protection can also be provided to members of the family of the threatened person, if ordered by a judge or prosecutor.
The analysis of the regulatory framework revealed serious deficiencies, such as the lack of a restrictive regime with respect to the movement and stay of the protected persons in public places. This has led to inefficient use of state resources by the Ministry of Internal Affairs in numerous cases in recent years.
Despite their vulnerability, the protected persons enjoy all civil and human rights, including the right to free movement. The regulatory framework does not impose any restrictions on the type, model, and brand of the vehicle used by them.
Sound and light signaling for the purposes of protection is used at the discretion of the protection team, without this being considered a violation of the rules.
Minister Mitov will initiate a dialogue with the Ministry of Justice and other competent institutions to regulate more clearly the procedure for protecting threatened individuals.
