Constitutional Court overturns decision on fuel prices: Parliament exceeded its authority

The Constitutional Court put an end to the dispute over oil price measures

With a unanimous decision of 12 votes, the Constitutional Court (CC) declared unconstitutional the decision of the National Assembly aimed at curbing the price shock in oil and natural gas.

The parliament's decision violates the principle of separation of powers and infringes upon the competence of the Council of Ministers, the CC emphasized.

Why was the decision overturned?

• Violation of the separation of powers: Parliament exceeded its powers under Article 8 of the Constitution.
• Budgetary process: The deputies encroached on the executive competence of the government in the preparation and execution of the budget.
• Contradiction with the law: The act contradicts the Public Finance Act.

The case arose after the sharp rise in fuel prices as a result of the conflict between the USA and Iran in March 2026. The caretaker government challenged the parliament's decision only weeks after its adoption, and the CC ruled on the case in a record short time of two months.
