Burgas: Ombudsman Investigates Mobile Operator Base Station

Burgas, Bulgaria - The ombudsman of Burgas Municipality, Todor Stamboliev, has taken action to investigate the circumstances surrounding the installation of a mobile operator's base station. The in-depth analysis began after a complaint was filed by citizens who expressed concerns about the legality of the installation.

According to the information provided by the municipal ombudsman, the complaint to him is supported by a petition that has collected over one hundred signatures. The signatories express serious concerns related to the potential non-compliance with the legal provisions regarding the placement of such facilities. The main problem they raise is the lack of approval from the General Assembly of the homeowners' association, as well as doubts about the existence of a valid building permit.

At the heart of the problem is a contract signed between a mobile operator and an individual. This contract was concluded without the knowledge or consent of the building managers and the other residents of the residential building, Stamboliev explained.

In his effort to protect the interests of citizens, the ombudsman emphasizes the need for a thorough investigation. "In the interest of society and the protection of the rights of the owners, it is necessary to determine whether the requirements of the Territorial Planning Act and the Condominium Management Act have been complied with," he said.

In this regard, Stamboliev sent an official request to the Chief Architect of Burgas Municipality. In his request, the ombudsman insists on a check for the existence of a building permit. In addition, it is required to establish whether there is a valid decision from the General Assembly of the homeowners' association. An important emphasis in the request is the verification of compliance with the applicable regulations, including Ordinance No. 21 for the construction of mobile telecommunications networks and facilities.
