European Elections: New Rules Expand Electoral Rights of Mobile Citizens

The Council of the European Union adopts a revolutionary directive that facilitates the participation of citizens in European elections outside their country of origin, while ensuring transparency and preventing abuses.

The European institutional system is taking significant steps to democratize the electoral process by adopting a modernized legislative framework aimed at mobile Union citizens. The new rules seek to remove administrative barriers that hinder the full political participation of European citizens.

The key objective of the directive is to provide easier access to information about electoral rights while creating an effective communication mechanism between member states. This includes prevention of potential electoral irregularities such as double voting or improper participation due to criminal convictions.

Among the main innovations are: introduction of standardized registration forms, multilingual information materials, and protective mechanisms against automatic deletion from the electoral lists of the country of origin. The Polish Minister for European Affairs, Adam Szlapka, emphasizes that these changes are of exceptional importance for the democratic consolidation of the European Union.

Statistical data confirm the necessity of such reforms. As of January 1, 2024, nearly 14 million mobile European citizens were potentially affected by existing restrictions. Previous practice shows a relatively low percentage of participation and application in electoral processes outside their home country.

The legislative act provides for a two-year transition period during which member states must adapt their national legislation to the new European standards. Publication in the Official Journal of the EU will mark the beginning of this process, with entry into force expected twenty days after the official announcement.

The legal basis of the directive is rooted in Article 22(2) of the Treaty on the Functioning of the European Union and Article 39 of the Charter of Fundamental Rights, which guarantee the electoral rights of citizens residing outside their country of origin. There are certain limitations, such as the prohibition of voting in more than one state during the same European elections.

The Commission emphasizes that this legislative initiative is part of broader efforts to promote broad and inclusive political participation. The goal is not only technical standardization but also real empowerment of European citizens by removing existing administrative barriers.

The new rules represent a significant step towards a more democratic and accessible European electoral system that respects the mobility and diversity of contemporary European society.
