Burgas Regional Court ordered "Detention" for S.C., accused of a serious traffic accident. The incident resulted in the death of six people. The investigation is ongoing, and the decision is subject to appeal.

Regional Court – Burgas imposed a pre-trial detention measure "Detention" against S.Ch., accused of causing a serious accident that resulted in the death of six people. The court case, examining the tragic incident, revealed the seriousness of the charges against S.Ch., causing a wide public reaction.

S.Ch. is facing trial on charges of committing crimes provided for in several articles of the Penal Code. The charges include violations specified in Art.281, para.2, item 1, item 3, item 5, item 6 and item 7 in connection with para.1 of the Penal Code, as well as under Art.342, para.3, letter "v", sub-item first in connection with para.1, pr.3 of the Penal Code in connection with Art.21, para.2 in connection with para.1, in connection with Art.103 of the Road Traffic Act, in connection with Art.47, para.3 of the Road Traffic Regulations and Art.180, para.1 of the Road Traffic Regulations. These charges underscore the complexity and severity of the case.

According to the indictment, on 06.11.2025, S.Ch. is accused of complicity in a crime related to the illegal assistance of foreigners. The crime was committed on road № II - 99, in the section from Primorsko to Burgas, on "Todor Aleksandrov" Blvd., in the direction of "Sportna" street. The charge states that, motivated by selfish motives, S.Ch. transported nine men, citizens of Afghanistan, including six with unidentified identities, violating the Law on Foreigners in the Republic of Bulgaria.

In addition, on the same date in Burgas, S.Ch. is accused of causing a serious accident. The incident, which occurred on "Todor Aleksandrov" Blvd., in the area of the intersection with "Sportna" street, occurred while driving a car. According to the indictment, S.Ch. violated the traffic rules, led to a road traffic accident and intentionally caused the death of six persons, who were passengers in the car, whose identity at the time of the incident is not established.

After reviewing the evidence gathered in the case and hearing the arguments of the parties, the Regional Court – Burgas decided that there is sufficient information for a reasonable assumption of S.Ch.'s involvement in the charges brought.

The court has concluded that the acts of the accused are of an extremely high degree of public danger. It is noted that his actions have endangered not only the lives and health of the passengers in the car, but also of many other road users, given the traffic load in the area.

The Regional Court finds grounds for the detention of S.Ch. under Art.63, para.1 of the Code of Criminal Procedure. There is a real danger that the accused will hide or commit other crimes. This danger is supported by the provision of Art.63, para.2, item 3 of the CPC, as S.Ch. is accused of a crime for which a penalty of not less than 10 years imprisonment or another more severe penalty is provided.

Although he has not been convicted to date, the fact that the accused does not have a permanent residence in Bulgaria, as well as the fact that he arrived for the purpose of committing a crime under Art. 281 of the Penal Code and subsequent withdrawal, further support the conclusion of a real danger of hiding and committing other crimes.

The investigation in the pre-trial proceedings continues at an intense pace, which necessitates the security of the presence of the accused for the needs of his timely investigation and completion.

The courtroom was filled with tension today. Those present carefully followed every movement, every word. The court's decision was met with some relief, as it ensures that the process will continue and those responsible will be brought to justice.

The court's ruling is subject to appeal with a private appeal and private protest before the Appeal Court – Burgas within three days.
