Reassessment for Disability Pension: New Rules and Deadlines

Clarifications regarding the reassessment for disability pension. It is important to adhere to the deadlines for submitting the application-declaration. New changes to the Regulation on Pensions and Insurance Service will come into effect in 2025.

According to the provisions of the Health Act, regional medical expert registries play a key role in the process of providing social protection for citizens. These services are obliged to promptly notify individuals who are subject to reassessment for permanently reduced working capacity. The notification must be sent no later than four months before the expiration of the term specified in the expert decision of the Territorial Expert Medical Commission (TEMC) or the National Expert Medical Commission (NEMC). This ensures that interested citizens are informed of the upcoming procedures and can take the necessary steps.

In order to be reassessed, citizens must submit an application-declaration to the relevant regional medical expert registry. This is an important procedure that starts the process of reviewing the medical condition of the person. The press center of the National Social Security Institute (NSSI) emphasizes the importance of this stage.

With the latest amendments and additions to the Regulation on Pensions and Insurance Service, the date of submission of the application-declaration for reassessment becomes key. The department explains that this date directly affects the continuity of the payment of the disability pension.

It is important to note that the payment of the disability pension is continued without interruption from the date following the one for which it was granted, provided that the application-declaration for reassessment has been submitted by the person before the expiration of the term of the last valid expert decision of the TEMC/NEMC. This also includes the allowance for foreign assistance.

In cases where the application-declaration for reassessment is submitted after that date, the payment of the disability pension, as well as the allowance for foreign assistance, is restored from the date of the reassessment. This emphasizes the importance of observing the deadlines for submitting the documents.

The mentioned changes in the Regulation on Pensions and Insurance Service are in force for application-declarations for reassessment submitted by individuals on December 2, 2025 and after that date. This clearly defines the scope of the new rules.

In another development, in August, "Information Services" announced the introduction of electronic decisions from the territorial expert medical commissions (TEMC). This allows patients with permanently reduced working capacity to receive the expert decisions entirely electronically, which represents a step towards digitalization and improving the service.
