Supreme Judicial Council Discusses Request to Dismiss Yordan Stoev: First Such Procedure

The Supreme Judicial Council will consider a request from members of parliament for the disciplinary dismissal of council member Yordan Stoev. The chairman of the SJC, Boyan Magdalinchev, announced an extraordinary meeting next week. Deputy Minister Tanya Radulovska commented that the request was belated.

A request has been received by the Supreme Judicial Council (SJC) from 48 members of parliament for the disciplinary dismissal of Yordan Stoev, a member of the council from the Prosecutors' College.

The Chairman of the SJC, Boyan Magdalinchev, announced to BTA that an extraordinary meeting on this issue will take place next week. He emphasized that the procedure is unique, happening for the first time.

By law, at least 1/5 of the members of parliament have the right to submit such a proposal for members of the SJC elected from the parliamentary quota. The Plenum of the SJC must make a decision within one month. The procedure includes a hearing of Yordan Stoev, discussion of the proposal and the information related to it, as well as the possibility of collecting additional data.

In case circumstances are established that damage the prestige of the judiciary, the Plenum of the SJC will assess what the final outcome should be.

The Deputy Minister of Justice, Tanya Radulovska, commented that in her opinion the request is late, as the public facts on which it is based occurred three years ago. She added that 1/5 of the judges and prosecutors also have the right to recall an elected member.
