The Constitutional Court has initiated a case regarding the 2026 budget laws
The Constitutional Court (CC) has officially initiated a case following a request from the Ombudsman concerning provisions in the transitional and final sections of the Law on the State Budget of the Republic of Bulgaria for 2026. The primary motive is a suspicion of non-compliance with the principles of a rule-of-law and social state.
The rapporteur for the case is Judge Sonya Yankulova, who will prepare a ruling on the admissibility of the complaint for substantive consideration.
What changes is Ombudsman Velislava Delcheva challenging?
- Calculation of length of service: Shifting from a model based on days worked to a system calculated by hours worked.
- Minimum wage: Removing the mechanism for the annual determination of remuneration without providing an alternative model or guarantees for future updates.
The Ombudsman insists that the lack of a clear mechanism for determining the minimum wage threatens the income of thousands of working Bulgarians. The CC is yet to rule on the admissibility of the request.
