The Appellate Court in Burgas reviews the measure for the driver who caused the tragedy on the "Trakia" motorway
The driver of the heavy goods vehicle, who was charged in connection with the serious accident on the "Trakia" motorway on July 10, appears today before the Appellate Court – Burgas. The driver's defense is appealing the most severe precautionary measure imposed by the first-instance court – "remand in custody".
We remind you that in the incident at the beginning of July, one man lost his life and two people were seriously injured.
Arguments of the defense and the prosecution
The accused's lawyers are insisting on changing the measure to a lighter one, such as "house arrest" or "bail". Their main arguments are:
- The driver's clean criminal record;
- The existence of a permanent address;
- The argument that the act was committed through negligence.
For its part, the prosecution remains firm in its request for the man to remain in custody. The state prosecution emphasizes the high social danger of the act, the serious consequences of the accident, and the risk that the professional driver might abscond.
The decision of the Appellate Court in Burgas will be final and not subject to further appeal.
