Support for the modernization of the criminal process
The Association of Prosecutors in Bulgaria (APB) has officially expressed its support for the draft Law on Amendment and Supplementation of the Criminal Procedure Code (CPC). The main goal of the changes is to reduce administrative formalism and ensure more predictable and efficient justice.
Efficiency and fairness are on the same side. A good procedural law must both accelerate the proceedings and guarantee the rights of the participants – Elitsa Kalpachka, Chair of the APB.
Key highlights of the proposed changes:
- Electronic service: Expanding its scope to the pre-trial phase for faster communication.
- Correction of errors: Possibility to correct obvious factual errors in the indictment without returning the case.
- Accelerated proceedings: Measures against unjustified inaction and limiting the formal termination of court cases.
Proposals for refinement
The APB suggests additional adjustments during the legislative procedure, including rules on notifying heirs and addressing technical issues with electronic service. The changes are aimed at resolving cases on their merits, rather than focusing on fixing minor oversights.
