Constitutional Court Gives Varna Appellate Court Deadline for Irregularities Regarding Acting Prosecutor General

The Constitutional Court (CC) has given the Varna Appellate Court a 14-day deadline to address irregularities in its request regarding the acting Prosecutor General, concerning the premature termination of the mandate, the appointment of an acting official, and the term of office.

The Constitutional Court (CC) has given the Varna Court of Appeal a 14-day deadline to remove irregularities in its request regarding the acting Prosecutor General.

The order was issued by the President of the Constitutional Court, Pavlina Panova, on January 5th.

The Varna Court of Appeal's request is about whether the text in the Law on the Judiciary (LoJ) contradicts the Constitution, regarding the early termination of the Chief Prosecutor's term, the designation of an acting official, and the length of time the same person performs these functions.

According to the President of the CC, the request does not meet the requirements of the law regarding its justification and what it consists of. The request must clearly state which constitutional provisions the legal text contradicts, providing arguments.

If the instructions are followed, a constitutional case will be opened. If the irregularities are not removed within the given deadline, the President will schedule a Constitutional Court session.
