Legal dispute over the fencing in "Baba Alino"
The Administrative Court in Varna has initiated important forensic expert assessments in the case of the company "VilApart Arcanum" (part of KUB Corporation). The company is appealing the order of the Regional Forestry Directorate to halt fencing activities on nine properties and to remove the existing structure.
The conflict escalated following a court decision on June 7, when the company's request to suspend the preliminary enforcement of the order was rejected, leading to the forced demolition of the fence.
Arguments of the parties
- Position of the company: According to "VilApart Arcanum", the territory has no special status and does not require a change of purpose.
- Position of the State Forestry Directorate: The directorate is adamant that the fence is illegal, a view the court initially agreed with.
What expert assessments did the court appoint?
To fully clarify the case, the court appointed two key expert assessments:
- Geodetic expert assessment: An expert will examine all cadastral, development, and regulatory plans of the "Baba Alino" area.
- Complex forestry and environmental expert assessment: Experts must determine whether the fence hinders the free movement of people, animals, and water, and whether it leads to habitat fragmentation and affects protected zones.
The case has been adjourned until September 30, when the experts are expected to present their conclusions.
