Varna Court Halts Case Regarding Complaint Against Election Commission's Silent Refusal

The Administrative Court in Varna dismissed the case, initiated by a complaint regarding the election commission's silent refusal to rule on signals concerning Mayor Blagomir Kotsev. The complaint was filed directly to the court, violating procedure.

The Administrative Court in Varna has left without progress a case initiated on an appeal regarding a tacit refusal by the Municipal Election Commission (MEC) to rule on two signals related to the powers of the Mayor of Varna Municipality, Blagomir Kotsev.

The appellant is attacking the inaction of the commission, stating that it did not rule within 14 days on the submitted signals.

After the conducted investigation, the court found that the appeal was filed directly to the Administrative Court, in violation of Art. 152 of the APC (Administrative Procedure Code).

Therefore, the proceedings on the case have been left without progress. The respondent has been given a 3-day period to send the administrative case file, as well as to express an opinion on the appeal.
