The court refused a lighter measure for the defendant
The Burgas District Court upheld the most severe remand measure for 19-year-old Nikola Burgazliev. He is accused of causing death by negligence while operating an ATV in the "Sunny Beach" resort complex, as well as inflicting serious bodily injuries on three people, including the child of the deceased woman.
During the scheduling hearing, the defendant asked for forgiveness from the victim's relatives and promised to work in order to financially support the injured child's treatment.
Defense arguments and magistrates' decision
The young man's lawyers requested the termination of the case and its return for further investigation due to procedural violations. Their main argument was related to the transfer of the investigation to Sofia, which they claimed was done illegally. The court, however, rejected these arguments, stating that there are no obstacles to the continuation of the trial.
- Accusation: Causing death and serious bodily injuries.
- Procedural status: Scheduling hearing.
- Position of the victims: The victim's relatives are demanding the maximum sentence.
The legislation provides for a penalty of up to 20 years of imprisonment or life imprisonment for the committed act.
