Burgas Mayor Proposes Transferring Reservoir near Mirolyubovo to the State

Burgas Mayor Dimitar Nikolov proposes that a reservoir in the lands of the village of Mirolyubovo be transferred to the state free of charge. The municipal council will discuss the proposal, which is prompted by the desire for the activities of management to be taken over by the State Enterprise "Management and Maintenance of Reservoirs."

The mayor of Burgas, Dimitar Nikolov, proposes that a reservoir near the village of Mirolyubovo be transferred free of charge to the state's ownership, it becomes known from a report submitted for consideration at the upcoming session of the Municipal Council (MC) - Burgas. The report is published on the official website of the MC.

The reservoir has an area of 35,702 sq. m and is located in the area of Zhaluda, in the land of the village. The reservoir is public municipal property.

In 2018, the Municipal Council had already given its consent for its free transfer to the state, but the Regional Governor of Burgas refused to accept the donation due to non-compliance with the requirements of the Water Act.

The mayor's report also states that the refusal does not constitute an obstacle to re-transfer after bringing the property into compliance with the legal requirements. In this regard, an amendment to the cadastral map and cadastral registers of the village of Mirolyubovo has been made, as a separate land property with a permanent use method "reservoir" has been created for the reservoir.

According to the mayor, it is appropriate for the activities of management, maintenance and operation of the municipal reservoirs to be taken over by the State Enterprise "Management and Maintenance of Reservoirs". Therefore, he proposes that the Municipal Council make a decision for the free transfer of ownership of the reservoir to the Bulgarian state.

BTA recalls that in 2018, the Law on Amendment and Supplementation of the Water Act provided for the possibility of reservoirs - municipal property - to be transferred free of charge to the state. In the same law, the State Enterprise "Management and Maintenance of Reservoirs" was created, which to carry out the complex management of reservoirs - public and private state property.
